THE CHICAGOLAND SPEEDWAY® RACEWAY CHALLENGE
1. HOW TO ENTER: NO PURCHASE NECESSARY TO ENTER OR WIN A PRIZE. A PURCHASE WILL NOT INCREASE YOUR CHANCES OF WINNING. The Chicagoland Speedway® Raceway Challenge (the “Promotion”) begins at 12:01 a.m. on March 25, 2008 and ends at 9:59 p.m. on November 14, 2008 (the “Promotion Period”). All times are Central Standard Time. To enter the Promotion, you must register at http://challenge.suntimes.com (“Promotion Site”). Registration is free and will require you to create a username and password.
During each week of the Promotion Period, beginning on 8:01 a.m. on each Tuesday and until 9:59 p.m. on each Friday, log on to the Promotion Site to select the NASCAR® driver that you think will earn the most NASCAR® driver points for the NASCAR® race on the following Saturday or Sunday. You may only pick each driver two (2) times during the course of the Promotion Period. You will be able to see who you have previously picked so you know the drivers available to you. Following the standard NASCAR® driver scoring system, you will earn the same number of NASCAR® driver points that the driver you selected earned that week. If you forget to make a driver selection for any particular week, you will receive no points for that week.
Limit one (1) entry into the Promotion per person. All entries become property of the Chicago Sun-Times LLC (“Sponsor”) and will not be returned. Entries that are forged, altered, or generated by a macro, bot, or other automated method will not be accepted and will be void. The Grand Prize winner will be required to travel to Chicago, Illinois, at his/her own expense, to take the Grand Prize trip and will also be required to provide his/her own ground transportation from Orlando, Florida to Daytona Beach, Florida to attend the NASCAR® events. The Grand Prize trip must be taken during February 2009. The specific dates of travel will depend on the actual dates of the NASCAR® events specified in the Grand Prize description. First Prize winners will be required to travel to Joliet, Illinois, at their own expense, to attend the NASCAR® events during July 2009.
2. ELIGIBILITY: The Promotion is open to legal residents of Illinois, Iowa, Indiana, and Wisconsin aged eighteen (18) years or older, except employees of the Sponsor, Raceway Associates, LLC, Ignite Solutions and their respective parent and affiliated companies, advertising agencies, and promotional partners, and relatives of and those living in the same household as such employees. For the purpose of this Promotion, relatives are defined as spouse, mother, father, in-laws, grandmother, grandfather, brother, sister, children and grandchildren. All federal, state and local laws and regulations apply. Void where prohibited.
3. SELECTION OF WINNERS: The entrant who has the most points at the end of the Promotion Period will be the grand prize winner, subject to the tie-breaker rules discussed below. After the grand prize winner is determined, the next ten (10) entrants who have the most points at the end of the Promotion Period will be first prize winners, subject to the tie breaker rules discussed below. Each week, one (1) entrant who correctly picks the winning driver will be randomly selected to win a weekly prize package. In the event of a tie, the entrant who selected the most weekly winning drivers over the course of the Promotion Period will win the tie. If there is still a tie, a random drawing of all tied entries will be held to determine the winners. The winners will be notified that they may have won a prize in this Promotion by mail, telephone or e-mail (at Sponsor’s sole discretion) on or about November 24, 2008. Winners may be required (in Sponsor’s sole discretion) to sign and return a claim form, an affidavit of eligibility and liability/publicity release within the time frame specified by Sponsor or the prize may be forfeited. Each winner’s guest (or, if the guest is a minor, then the winner on behalf of the guest) may also be required (in Sponsor’s sole discretion) to sign a liability/publicity release within the time frame specified by Sponsor. In the event of noncompliance with this requirement, such winner and/or guest will be refused travel and prize may be forfeited. All prize claims, affidavits of eligibility and liability/publicity releases are subject to verification by Sponsor. If any prize notification or Promotion communication is rejected or returned as undeliverable or if a winner cannot be reached after a reasonable attempt has been made by Sponsor (as determined by Sponsor in its sole discretion), such winner may be disqualified and an alternate winner may be selected. Each participant’s name and driver selection may be published in the Chicago Sun-Times newspaper or at the Promotion Site throughout the Promotion Period. Any standings published in the Chicago Sun-Times newspaper or at the Promotion Site are for informational purposes only and are not determinative of ultimate winner selection. Ultimate winner selection will be determined by Sponsor. In order to claim prize, additional releases required by Daytona International Speedway, LLC, Raceway Associates, LLC and/or any applicable sanctioning body shall also be required as applicable.
4. PRIZES/ODDS: The Grand Prize winner will receive round-trip, economy airfare for the Grand Prize winner and one (1) guest from O’Hare International Airport in Chicago, Illinois to Orlando, Florida, three (3) nights hotel accommodations (based on double occupancy) at a hotel in Daytona Beach, Florida selected by Sponsor, two (2) tickets to the Nationwide Series Race at Daytona International Speedway®, two (2) tickets to the Sprint Cup Series™ Race at Daytona International Speedway® (the DAYTONA 500®), two (2) passes to the Daytona International Speedway® fan hospitality area, and two (2) passes to the Sprint Fan Zone. Approximate retail value (“ARV”) of the Grand Prize: $4,000. The NASCAR® events at Daytona International Speedway® are currently scheduled to take place during February 2009. The actual dates will be determined by the sanctioning body. Grand Prize winner must travel on dates specified by Sponsor or Grand Prize may be forfeited. Specific travel arrangements will be made in Sponsor’s sole discretion. Air travel must originate from and end at O’Hare International Airport. Flight schedules are subject to change without notice. Sponsor is not liable for any expenses incurred as a consequence of flight cancellation/delay. The Grand Prize winner may be required to provide a credit card at time of hotel check-in. The Grand Prize winner and his/her guest(s) must travel together on the same itinerary, including the same departure date, destination and return date. Pit and garage access are subject to the rules and regulations of Daytona International Speedway, LLC and any applicable sanctioning body. In order to claim prize, additional waivers and/or releases of liability required by Daytona International Speedway, LLC and/or or any applicable sanctioning body shall also be required as applicable.
Ten First Prize winners each will receive two (2) tickets to the Nationwide Series Race at the Chicagoland Speedway®, two (2) tickets to the Sprint Cup Series™ Race at the Chicagoland Speedway®, two (2) Cold Garage and Pit passes, and two (2) passes to the Speedway Club. ARV of each First Prize: $2,500. The NASCAR® events at the Chicagoland Speedway® are currently scheduled to take place during July 2009. The actual dates will be determined by the sanctioning body. Pit and garage access are subject to the rules and regulations of Raceway Associates, LLC and any applicable sanctioning body. In order to claim prize, additional waivers and/or releases of liability required by Raceway Associates, LLC and/or or any applicable sanctioning body shall also be required as applicable.
Thirty-two (32) Weekly Prize Winners each will receive a prize package including Chicagoland Speedway and Chicago Sun-Times logo merchandise. ARV of each Weekly Prize: $25
Total ARV of all prizes: $29,800.00.
By entering this Promotion and accepting a prize, each winner agrees to maintain his/her behavior in accordance with all applicable laws and generally accepted social practices in connection with participation in any Promotion activity, including use of the prize. Each winner understands and agrees that Sponsor, Raceway Associates, LLC, Daytona International Speedway, LLC and sanctioning bodies have the right, in their sole discretion, to disqualify and remove the winner or his/her guest from any activity at any time if the winner or his/her guest’s behavior at any point is disruptive or may or does cause damage to person, property or the reputation of Sponsor, Raceway Associates, LLC, Daytona International Speedway, LLC and sanctioning bodies or otherwise violates the policies of the prize providers.
Odds of winning depend on number of eligible entries received and each entrant’s knowledge of NASCAR® racing and drivers. All prizes legitimately claimed will be awarded. All meals, gratuities, in-room charges, travel expenses, transfers, taxes, ground transportation and other expenses not specified herein, including, without limitation, travel expenses to and from the Grand Prize winner’s residence and Chicago, Illinois and to and from Orlando and Daytona Beach and travel expenses to and from First Prize winner’s residence and Joliet, Illinois, are the sole responsibility of the winner. No transfers, prize substitutions or cash redemptions will be made, except at Sponsor’s sole discretion. Sponsor reserves the right to substitute the stated prize with another prize of equal of greater value should the stated prize become unavailable. Notwithstanding the foregoing, Sponsor is not responsible and will not be liable in the event any NASCAR® event is postponed or cancelled after the prize has been awarded. No more than the stated number of prizes will be awarded. If any winner’s guest is a minor, the winner must be the guest’s parent/legal guardian.
5. LIMITATION OF LIABILITY: EACH PARTICIPANT AGREES TO RELEASE, HOLD HARMLESS AND INDEMNIFY SPONSOR, RACEWAY ASSOCIATES, LLC, DAYTONA INTERNATIONAL SPEEDWAY, LLC, NASCAR, AND THEIR RESPECTIVE PARENTS, DIVISIONS, SUBSIDIARIES, AFFILIATES, ADVERTISING, PROMOTION, AND PUBLIC RELATIONS AGENCIES, AND THE RESPECTIVE OFFICERS, DIRECTORS, EMPLOYEES, REPRESENTATIVES AND AGENCIES OF EACH, THE DAYTONA BEACH RACING & RECREATIONAL FACILTIES DISTRICT, THE CITY OF DAYTONA BEACH AND THE COUNTY OF VOLUSIA FOR ANY LIABILITY WHATSOEVER FOR INJURIES OR DAMAGES OF ANY KIND SUSTAINED IN CONNECTION WITH THE USE, ACCEPTANCE, POSSESSION, USE, MISUSE OR AWARDING OF THE PRIZE OR WHILE PREPARING FOR, PARTICIPATING IN AND/OR TRAVELING TO OR FROM ANY PRIZE- OR PROMOTION-RELATED ACTIVITY, INCLUDING, WITHOUT LIMITATION, ANY INJURY, DAMAGE, DEATH, LOSS, OR ACCIDENT TO PERSON OR PROPERTY. EACH WINNER AGREES THAT THE PRIZE IS PROVIDED AS-IS WITHOUT ANY WARRANTY, REPRESENTATION, OR GUARANTEE, EXPRESS OR IMPLIED, IN FACT OR IN LAW, WHETHER NOW KNOWN OR HEREINAFTER ENACTED, RELATIVE TO THE USE OR ENJOYMENT OF THE PRIZE, INCLUDING, WITHOUT LIMITATION, ITS QUALITY, MERCHANTABILITY, OR FITNESS FOR A PARTICULAR PURPOSE. FURTHER, NO RESPONSIBILITIES ARE ACCEPTED FOR ANY ADDITIONAL EXPENSES, OMISSIONS, DELAYS, RE-ROUTING, OR ACTS OF ANY GOVERNMENT OR AUTHORITY. EACH WINNER ACKNOWLEDGES THAT HE/SHE IS SOLELY RESPONSIBLE FOR ANY ACTIONS, CLAIMS OR LIABILITIES OF HIS/HER GUEST RELATED TO ANY PROMOTION ACTIVITY, INCLUDING, WITHOUT LIMITATION, ANY ACTIONS, CLAIMS OR LIABILITIES RELATED TO THE GUEST’S USE OF THE PRIZE.
6. ADDITIONAL DISCLAIMERS: Sponsor is not responsible and/or liable for any of the following, whether caused by Sponsor, the entrant, or by human error: any lost, late, incomplete, illegible, mutilated, misdirected or postage-due entries or mail; error, omission, interruption, defect or delay in transmission or communication; technical or mechanical malfunctions; interrupted or unavailable cable or satellite systems; errors, typos, or misprints in these official rules, in any Promotion-related advertisements or other materials; any viruses or failures of electronic equipment, computer hardware or software; lost or unavailable network connections, or failed, incorrect, incomplete, inaccurate, garbled or delayed electronic communications or entry information.
7. GENERAL RULES: By entering the Promotion, (except where prohibited by law) entrants consent to the use of their names, pictures, likenesses, voices, biographical data, and/or any information contained in their entry in advertising, promotion and marketing materials throughout the world, including on the internet, by the Sponsor, its promotional partners, and third party marketing entities, without additional compensation, notice, review, or approval. Sponsor’s decisions will be final in all matters, including interpretation of these official rules and awarding of the prizes. DO NOT call Sponsor, as this Promotion will not be discussed by phone, except at Sponsor’s sole discretion. All participants, as a condition of entry, agree to be bound by these official rules and the decisions of Sponsor. Failure to comply with these official rules may result in disqualification from this Promotion. Sponsor reserves the right to permanently disqualify any person it believes has intentionally violated these official rules. Participants further agree to not knowingly damage or cause interruption of the Promotion and/or prevent others from using the Promotion. Sponsor reserves the right, in its sole discretion, to void entries of any entrants who Sponsor believes have attempted to tamper with or impair the administration, security, fairness or proper play of this Promotion. If the Promotion is not capable of running as planned for any reason, Sponsor reserves the right, in its sole discretion, to cancel, modify or suspend the Promotion and award the prizes from among entries received prior to or after the date of the cancellation, modification or suspension. Any person who supplies false information, obtains entries by fraudulent means, or is otherwise determined to be in violation of these official rules in an attempt to obtain any prize will forfeit any prize won and may be prosecuted to the full extent of the law. In the event of a dispute concerning who submitted an entry via the Internet, the entry will be declared to have been made by the authorized account holder of the e-mail address submitted at time of entry, but only if that person meets all other eligibility criteria. An authorized account holder is defined as the natural person who is assigned to an e-mail address by an Internet access provider, online service provider, or other organization (e.g. business, educational institution, etc.) that is responsible for assigning e-mail addresses for the domain associated with the submitted e-mail address. CAUTION: ANY ATTEMPT TO DAMAGE ANY ONLINE SERVICE OR WEBSITE OR UNDERMINE THE LEGITIMATE OPERATIONS OF THE PROMOTION VIOLATES CRIMINAL AND CIVIL LAWS. IF SUCH AN ATTEMPT IS MADE, SPONSOR MAY DISQUALIFY ANY PARTICIPANT MAKING SUCH ATTEMPT AND MAY SEEK DAMAGES TO THE FULLEST EXTENT PERMITTED BY LAW.
8. WINNERS LIST: For a list of winners, send a legal-size, self-addressed, stamped envelope to: Chicagoland Speedway® Raceway Challenge, 350 North Orleans, 10th Floor, Chicago, IL 60654. Requests must be received no later than three (3) months from the close of the Promotion.
